A consumer complaint is a formal legal proceeding filed before a Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019. It is filed when a consumer suffers loss due to defective goods, deficient services, unfair trade practices, or misleading advertisements by a seller, manufacturer, or service provider.
Any consumer who has purchased goods or availed services for personal use can file a complaint. This includes individuals, families, and even legal entities. You can also file a complaint on behalf of a group of consumers with similar grievances (class action complaint).
The Consumer Forum can award compensation for the loss or injury suffered, replacement of defective goods, refund of price paid, removal of deficiency in service, compensation for mental agony and harassment, and punitive damages for unfair trade practices. There is no upper limit set by the Act.
Under the Consumer Protection Act, 2019, complaints are supposed to be resolved within 3 months from the date of admission (5 months if laboratory testing is required). In practice, most cases at the District Forum are resolved within 6-12 months. Appeals take additional time at the State and National Commissions.
