What is SIM Swap Fraud?
SIM swap fraud occurs when a fraudster obtains a duplicate SIM card from the mobile network operator by pretending to be the legitimate subscriber. Once the fraudster has the new SIM, they can intercept OTPs, SMS alerts, and phone calls, enabling them to access bank accounts, social media, and other secured services.
The fraudster typically gathers personal information through phishing, data breaches, or social engineering. They then visit the mobile operator's store with fake documents and request a duplicate SIM, claiming the original is lost or damaged. After the new SIM is activated, the victim's SIM stops working.
SIM swap fraud is particularly dangerous because it bypasses two-factor authentication. The fraudster can reset passwords on bank accounts, email, and social media using the intercepted OTPs, causing significant financial and personal damage.
How to Detect SIM Swap Fraud
The most common sign of SIM swap fraud is losing mobile network connectivity suddenly. If your phone shows 'No Service' or 'Emergency Calls Only' despite being in a good coverage area, your SIM may have been swapped. You may also stop receiving SMS messages and calls.
Another sign is receiving notifications about password reset requests for your bank accounts, email, or social media that you did not initiate. You may receive alerts about transactions or changes to your accounts that you did not authorize.
Sometimes the mobile operator may send a confirmation SMS about SIM replacement. If you receive such a message without making a request, take immediate action. Regular monitoring of your bank account and mobile connectivity is essential.
Immediate Steps After Detecting SIM Swap Fraud
As soon as you suspect SIM swap fraud, immediately contact your mobile operator to report the unauthorized SIM replacement and request blocking of the fraudulent SIM. Verify your identity and request restoration of your original SIM.
Contact your bank and financial institutions immediately. Inform them about the SIM swap fraud and request them to freeze your accounts, block cards, and stop all transactions. Change your online banking passwords and disable SMS-based two-factor authentication.
Call the cyber crime helpline at 1930 to report the fraud. File a complaint on the National Cyber Crime Reporting Portal at cybercrime.gov.in. Also file an FIR at the local police station. The mobile operator must provide details of when and where the duplicate SIM was issued.
Legal Recourse and Prevention
SIM swap fraud is punishable under Section 66C (identity theft) and Section 66D (cheating by personation) of the IT Act, along with Section 420 of the IPC. The mobile operator can be held liable for negligence if they issued the duplicate SIM without proper verification.
Victims can claim compensation from the mobile operator for negligence and from the bank if the fraud was facilitated by inadequate security measures. File a complaint with the Telecom Regulatory Authority of India (TRAI) against the mobile operator.
Prevent SIM swap fraud by setting a SIM lock PIN with your mobile operator. Use app-based two-factor authentication (like Google Authenticator) instead of SMS-based OTPs. Be cautious about sharing personal information. Monitor your mobile connectivity regularly.
