    Understanding EPF Applicability

    The Employees' Provident Funds and Miscellaneous Provisions Act, 1952 applies to every establishment employing 20 or more persons. The Act covers factories and other establishments specified in the Act. Certain establishments with less than 20 employees can voluntarily register.

    Once the Act applies to an establishment, it continues to apply even if the number of employees falls below 20. The Act also applies to establishments that have voluntarily applied the provisions through a resolution of the majority of employees and employers.

    Establishments covered under the Act must register with the Employees' Provident Fund Organisation (EPFO) and comply with the EPF Scheme, Employees' Pension Scheme (EPS), and Employees' Deposit Linked Insurance (EDLI) Scheme.

    Registration Process on EPFO Portal

    EPF registration is done online through the EPFO Unified Portal. Visit https://epfunifiedportal.epfindia.gov.in and click on 'Establishment Registration'. Register as a new user with your establishment details.

    Fill in Form 5A online providing details of the establishment including name, address, nature of business, date of commencement, PAN, GST registration, and bank account details. Upload scanned copies of required documents including certificate of incorporation, PAN card, address proof, and board resolution.

    After submission, the application is processed by the EPFO regional office. The employer is allotted a 17-digit Establishment ID (Reg No). The registration certificate is issued online. New employees must be enrolled within 15 days of joining.

    Contribution Requirements

    Once registered, both employer and employee contribute 12% of the employee's basic wages and dearness allowance. The employer's contribution is split as: 3.67% to EPF, 8.33% to EPS, and 0.5% to EDLI. The employee's entire 12% goes to EPF.

    Administrative charges are payable by the employer at 0.5% of wages for EPF administration and 0.01% for EDLI administration. Contributions must be deposited online through the EPFO portal by the 15th of the following month.

    The employer must file monthly contribution returns (ECR - Electronic Challan cum Return) showing wage details, contributions, and member details. The employer must also maintain registers for PF contributions, advances, and claims.

    Compliance and Penalties

    Employers must ensure timely deposit of contributions, filing of returns, and maintenance of records. Non-compliance can result in damages at 12% per annum for delayed contributions and up to 25% for default. Prosecution can lead to imprisonment up to 3 years and fine.

    The EPFO conducts inspections and audits to verify compliance. Employers must cooperate with inspectors and provide access to records. Non-cooperation can result in penalties.
