How to File a Consumer Complaint in India: A Complete Guide

As consumers, we all purchase goods and services—sometimes these fall short of expectations or the promises made by the seller. The Consumer Protection Act, 2019 provides a robust legal framework for redress. Filing a consumer complaint is a powerful, relatively inexpensive way to seek refunds, replacements, and compensation for defective products, deficient services, or unfair trade practices. This guide explains the law, the forums, the procedure, and the documents you need to file a consumer complaint successfully.

Who Is a Consumer Under the 2019 Act?

Under Section 2(7) of the Consumer Protection Act, 2019, a consumer is a person who buys goods or avails services for personal use, on payment of a consideration. Importantly, a person who buys goods for resale or commercial purposes is not a consumer. The 2019 Act also expanded the definition to cover online and electronic transactions—so e-commerce buyers are protected too.

Rights of a Consumer

The Act recognises six consumer rights:

  • Right to be protected against goods and services hazardous to life and property
  • Right to be informed about quality, quantity, and price
  • Right to choose from a variety of goods and services at competitive prices
  • Right to be heard and to have grievances redressed
  • Right to seek redressal against unfair trade practices or exploitation
  • Right to consumer education

Types of Consumer Complaints

You can file a complaint for:

  • Defective goods: Products that are unsafe, malfunctioning, or not as described.
  • Deficiency in service: Poor or incomplete service from banks, hospitals, builders, telecom providers, or insurance companies.
  • Unfair trade practices: False advertising, misleading offers, bait-and-switch tactics.
  • Overcharging: Charging above the MRP or agreed price.
  • E-commerce issues: Non-delivery, wrong product, or refusal of return/refund.
  • Product liability: Harm caused by a defective product—manufacturer, seller, and service provider can all be held liable under Chapter VI of the Act.

Consumer Forums: Where to File

The 2019 Act established a three-tier dispute redressal system based on the value of the claim:

ForumJurisdiction (Claim Value)
District Consumer Disputes Redressal CommissionUp to ₹50 lakh
State Consumer Disputes Redressal Commission₹50 lakh to ₹2 crore
National Consumer Disputes Redressal Commission (NCDRC)Above ₹2 crore

Appeals from the District Commission go to the State Commission, then to the NCDRC, and finally to the Supreme Court. The limitation period to file a complaint is two years from the date the cause of action arose.

Step-by-Step Process to File a Consumer Complaint

Step 1: Gather Evidence

Collect all relevant documents—cash memos, invoices, warranties, emails, chat records, photographs of the defective product, and any correspondence with the seller. These documents form the backbone of your complaint.

Step 2: Send a Notice to the Opposite Party

Before approaching the forum, send a written notice to the seller or service provider describing the deficiency and demanding redressal. Give them a reasonable time—usually 14 to 30 days—to respond. Many disputes are resolved at this stage. Use our legal notice service to draft a strong notice.

Step 3: File the Complaint

If the opposite party does not respond or the response is unsatisfactory, file a complaint before the appropriate consumer forum. The complaint can be filed in the district where you reside or work, or where the opposite party resides or conducts business—this is a significant convenience introduced by the 2019 Act.

Step 4: Draft the Complaint

The complaint should contain: (1) the name and address of the complainant; (2) the name and address of the opposite party; (3) the facts of the case; (4) the relief sought—refund, replacement, compensation, or all; and (5) the jurisdiction of the forum. You can file in person, by registered post, or online through the e-Daakhil portal (edaakhil.nic.in).

Step 5: Pay the Filing Fee

The fee is based on the claim value:

  • Up to ₹5 lakh: No fee (for cases filed by legal heirs of a deceased complainant) / nominal fee otherwise
  • ₹5 lakh to ₹10 lakh: ₹200
  • ₹10 lakh to ₹20 lakh: ₹400
  • ₹20 lakh to ₹50 lakh: ₹1,000
  • Above ₹50 lakh: ₹5,000

For State and National Commission, the fees are higher as per the rules.

Step 6: Admission and Hearing

The forum admits the complaint if it discloses a cause of action. Notice is sent to the opposite party, who must respond within 30 days. The forum conducts hearings, takes evidence, and delivers a judgement—usually within three months for admission and twelve months for disposal, though practical timelines vary.

Relief Available

The forum can grant:

  • Refund of the amount paid
  • Replacement of the defective good
  • Compensation for mental harassment, financial loss, and litigation costs
  • Discontinuance of unfair trade practices
  • Punitive damages in cases of gross negligence

Consumer Complaints Against Builders and Banks

The Supreme Court has repeatedly held that homebuyers are consumers and can file complaints against builders for delay in possession and structural defects. Similarly, deficiency in banking services—unauthorized charges, failure to honour cheques, or mis-selling insurance—can be challenged before the consumer forum. Mediation Under the 2019 Act

The Act introduces a mediation mechanism—complaints can be referred to a Mediation Cell attached to the consumer forum. This is faster and less adversarial, and a settlement reached through mediation has the force of a court order.
